Is a HELOC a Second Mortgage?
Usually, yes. If you already have a mortgage, a HELOC on the same home sits behind it as a second mortgage, also called a junior lien. If your home is paid off, or the HELOC pays off what's left on your mortgage, the HELOC becomes the first lien instead. A home equity loan follows the same rule, and either way your first mortgage keeps its rate and terms.
Last updated October 31, 2026What makes a HELOC a "second" mortgage?
"Second" is about the order of payment, not the order you took out the loans. If a home has to be sold to pay off what's owed on it, the first mortgage is paid in full before the second lien gets anything. That's why second mortgages often carry higher rates than first mortgages.
HELOCs and home equity loans are the two most familiar second mortgages. What sets them apart is how you get the money. A HELOC is open-end: you can draw, repay and draw again up to your limit. A home equity loan is closed-end: you get one lump sum and can't redraw.
Can a HELOC be a first mortgage?
Yes. On a home with no mortgage, a HELOC is the only loan against it, so it's in first position. The same is true when a HELOC pays off a small remaining mortgage balance.
Lots of homes have no mortgage for a HELOC to sit behind. In 2024 the Census Bureau counted about 34.9 million owner-occupied homes with no mortgage at all, 40.3% of the total. It also counted about 1.4 million with a home equity loan and no primary mortgage.
Does a second mortgage change my first mortgage?
No. Your first mortgage's rate, payment and term stay exactly as they are. The HELOC lender does take it into account: the amount you can borrow is generally a percentage of your home's appraised value minus what you still owe on the mortgage.
If you refinance your first mortgage later and keep the HELOC open, the HELOC lender usually signs a subordination agreement so the new first mortgage stays in first place. Fannie Mae generally requires a recorded one when a second lien stays in place on a first-mortgage refinance it buys, unless state law keeps the second lien's position on its own terms. It's one more signature to line up, so ask about it early.
It depends on your situation:
- You have a mortgage and open a HELOC: the HELOC is a second mortgage.
- Your home is paid off: the HELOC is the first lien.
- The HELOC pays off your remaining balance: it moves into first position.
- You refinance your first mortgage later: the HELOC lender agrees in writing to stay second, or the HELOC is paid off at closing.
